Terms & Conditions


  • Introduction
  • These terms and conditions (the "Terms and Conditions") apply to the sale of (the "Artwork") by (the "Artist") by the Irish Museum of Modern Art to you.

  • TITLE AND RISK
  • As soon as the purchase price is paid in full, you will become the legal owner of the Artwork and, upon such payment, you will be responsible for the Artwork and the risk of damage to, or loss of the Artwork, will pass to you.

  • OWNERSHIP OF THE ARTWORK COPYRIGHT
  • The Artwork was specially commissioned in conjunction with the exhibition of work by the Artist and the Irish Museum of Modern Art (the "Exhibition"). The Artist has worked closely with the Irish Museum of Modern Art to produce the Artwork on the strict understanding that it will be available for purchase exclusively through the Irish Museum of Modern Art or any other outlet approved by the Irish Museum of Modern Art.
  • Copyright in the Artwork remains the property of the Artist.
  • You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction, any image of the Artwork to any third party, including any Internet website for any purpose.
  • If you breach any of your obligations under paragraph 3.3 you agree that: The payment of damages will not be a sufficient remedy to compensate us or the Artist for your breach:
  • We may, and the Artist may, apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and
  • We may, and the Artist may, contact the operator of any Internet website on which the Artwork is being offered for sale, or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.

  • DATA PROTECTION
  • We may collect, hold, control, use and transmit personally identifiable information obtained form you in the course of your purchase of the Artwork. By agreeing to these Terms and Conditions you agree to such information being used in these ways, and for such information to be disclosed to the Artist if you are in breach of your obligations under these Terms and Conditions.

  • LIABILITY OF THE IRISH MUSEUM OF MODERN ART
  • We make no representation or warranty of any kind whatsoever, express or implied, in connection with the Artwork. The Irish Museum of Modern Art and its officers, directors, employees, shareholders or agents exclude all liability (whether in contact, tort or otherwise), to the fullest extent permitted by applicable law, for any loss or damage that may result to you or a third party in connection with the Artwork.

  • RIGHTS OF THIRD PARTIES
  • No person other than you and the Irish Museum of Modern Art have any rights under the Terms and Conditions other than in respect of paragraph 3 above, which confers a benefit on the Artist, and is intended to be enforceable by the Artist.

  • GOVERNING LAW AND JURISDICTION
  • These Terms and Conditions shall be governed by and construed in accordance with Irish law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the Irish courts

  • DELIVERY AND RISK
  • The goods you order will be delivered to the address you give when you place your order, subject to confirmation of your order by IMMA.
  • All editions ordered outside Ireland will be sent to you via a secure courier service within 14 days after receiving payment or within such other period indicated at the time you place your order.
  • All edition orders made in Ireland must be collected from the museum. In this case your item will be available for collection at the time of purchase or at any other date and time so agreed. Please telephone the Museum to confirm a collection date at tel: +353-1-612 9951
  • Delivery charges outside of Ireland are specified and included when purchasing an item
  • If goods do not arrive within the time specified please contact us at email: editions@imma.ie or books@imma.ie
  • Every effort will be made to deliver the goods within the time periods specified above. If IMMA is unable to deliver the goods within 30 days of receiving your order, IMMA will inform you as soon as possible and you will be entitled to cancel the order and obtain a refund or re-credit for any sum that has been paid by you or debited from you credit card for the goods. IMMA will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

  • CANCELLATION AND REFUND
  • You have the right to cancel your order at any time up to the end of 7 working days after you receive the goods
  • If you exercise your right of cancellation after the goods have been delivered to you, you must return the goods to IMMA at your own cost, in unused and otherwise re-saleable condition.The goods must be adequately sealed in the original packaging and you must take reasonable care to ensure the goods are not damaged whilst in your possession or in transit.
  • IMMA will refund or re-credit you within 30 days of receiving notice of such cancellation for any sum that has been paid by you or debited from your credit card for the goods.
  • If you do not return the goods as required after exercising your right of cancellation, IMMA may charge you for the direct costs of recovering the goods.
